INTRODUCTION

The following terms and conditions (hereinafter referred to as the “Terms and Conditions”) form the contractual agreement for your holiday booking with SCUBASPA Global Operations (hereinafter referred to as the “SCUBASPA”).

General Terms and Conditions

(APPLICABLE TO ALL DESTINATIONS)

1. Contract Formation

1.1 By confirming a booking with SCUBASPA, you (hereinafter referred to as the “Guest”) agree to enter into a cruise holiday contract with SCUBASPA, subject to the terms outlined herein.

1.2 A legally binding contract is formed once SCUBASPA receives deposit payment from the Guest, and confirms the booking in writing via email.

1.3 By confirming the booking, the Guest affirms that they are authorized to accept the Terms and Conditions on behalf of all individuals included in the reservation. Acceptance on behalf of any minor is deemed to have been given by a parent or legal guardian.

2. Rates

2.1 All rates published on SCUBASPA’s official website are quoted in USD, per person and based on double occupancy (two persons sharing a suite), unless stated otherwise.

2.2 A single-stay supplement applies when a Guest books a suite for a single occupancy or when one of two Guests in a double suite cancels their reservation; such supplements vary by destination and are specified in Section 4 of the relevant Destination-Specific Terms and Conditions.

2.3 Minors are charged at the full adult rate. Minimum age vary by destination and is specified in Section 5 of the relevant Destination-Specific Terms and Conditions.

2.4 Unless clearly stated otherwise, the website rates apply to all types of holiday packages offered by SCUBASPA. Rates exclude service and administration fee and government taxes, where applicable.

2.5 Additional supplements may apply to specific cruises or itineraries. Information about such supplements will be clearly indicated and made publicly available on Scubaspa’s official website.

2.6 SCUBASPA reserves the right to adjust published prices due to external factors, including but not limited to currency fluctuations, changes in local taxes, operational costs and inflation. Rates confirmed by SCUBASPA at the time of booking shall remain fixed and existing bookings shall not be affected by any subsequent price changes, promotions, or adjustments.

2.7 Bookings made under promotional offers are subject to specific terms and conditions that may differ from those applicable to standard bookings. In the event of a change to the travel dates, the original promotion or discount shall no longer apply, and the revised booking shall be recalculated based on the standard rates in effect at the time the amendment is confirmed.

3. Payment Policy

3.1 The Guest has seven (7) calendar days from the date the booking option is created to confirm the reservation. Confirmation requires full payment of the deposit - equivalent to twenty-five percent (25%) of the booking value, and submission of payment confirmation to SCUBASPA via email. If the booking is not confirmed within this timeframe, the option will be automatically cancelled without further obligation. The twenty-five percent (25%) deposit is strictly non-refundable under any circumstances.

3.2 The remaining balance is due no later than sixty (60) days prior to the departure date. In case of any outstanding balance less than sixty (60) days prior to departure, the booking will be automatically cancelled without entitlement to any refund.

3.3 For bookings made less than sixty (60) days prior to the departure date, full payment is required within seventy-two (72) hours of booking. Proof of payment must be submitted to SCUBASPA via email within the same period in order to secure the reservation.

3.4 All payments to SCUBASPA should be made via bank transfer or credit / debit card.

3.5 All costs associated with payment processing - including but not limited to bank fees, credit card charges, and currency exchange fees - are the sole responsibility of the Guest.

4. Cancellations

4.1 CANCELLATION BY THE GUEST

4.1.1 All cancellations must be submitted in writing to reservations@scubaspa.com and will take effect on the date they are received.

4.1.2 The following cancellation fees shall apply based on the number of days prior to the scheduled departure date:

a. More than 120 days before the departure date - a cancellation fee of twenty-five percent (25%) of the total booking value applies. Alternatively, the 25% deposit may be credited toward a future booking under the same name, provided the new departure date falls within twelve (12) months of the date SCUBASPA is notified of the cancellation.

b. Between 60 and 120 days before the departure date - a cancellation fee of twenty-five percent (25%) of the total booking value applies; no refunds or credits will be issued.

c. 60 days or less before the departure date - a cancellation fee of a hundred percent (100%) of the total booking value applies; no refunds or credits will be issued.

4.1.3 In the event that one (1) of two (2) Guests sharing a double suite cancels sixty (60) or more days prior to departure date, the following terms apply:

a. Full deposit paid for the Guest who cancells (25% of the Guest’s booking value) may be credited toward a future booking under the same name, provided the new departure date falls within twelve (12) months of the date SCUBASPA is notified of the cancellation.

b. A single stay supplement shall be applied to the remaining Guest’s booking.

4.1.4 No refunds shall be issued for no-shows.

4.1.5 In the event that the cancellation is due to official travel restrictions imposed by government authorities, including but not limited to border closures or flight suspensions, all deposits paid may be credited in full toward a future booking.

4.2. CANCELLATION BY SCUBASPA

4.2.1 SCUBASPA guarantees cruise departures with a minimum of twelve (12) Guests. Should this minimum not be reached, SCUBASPA reserves the right to cancel the scheduled cruise.

4.2.2 In the event of cancellation due to insufficient occupancy, SCUBASPA shall notify the Guest no less than twenty-one (21) days prior to the scheduled departure date.

4.2.3 In case of cancellations made by SCUBASPA, all related payments received from the Guest shall be promptly and fully refunded by SCUBASPA. This refund shall constitute the full extent of SCUBASPA’s liability with respect to the cancelled booking.

4.2.4 SCUBASPA shall not be held liable for any expenses incurred by the Guest in preparation for the booked cruise. This includes, but is not limited to, non-refundable airline tickets or associated cancellation fees, transportation, accommodation, meals, special clothing or equipment purchases, visa or passport fees, or any other related costs.

4.2.5 In the event that the Guest cannot be accommodated onboard due to circumstances directly attributable to SCUBASPA - such as technical issues with the vessel - the Guest will be accommodated at another suitable vessel at no additional cost.

5. Booking Amendments Policy

5.1 An amendment request by the Guest refers to minor modifications to the original booking and does not include changes to travel dates or destination. Amendments may include, but are not limited to, changes to guest names, updates to package types, or suite category adjustments.

5.2 All booking amendment requests by the Guest must be submitted in writing via email. The Guest acknowledges that amendments may incur additional charges and are subject to SCUBASPA’s approval. SCUBASPA reserves the right to accept or decline any requested changes at its sole discretion.

5.3 In the event of a Guest's late arrival or early departure from an ongoing cruise, SCUBASPA shall assist the Guest in organizing transfer from or to the nearest airport or another designated location. However, SCUBASPA does not guarantee the availability of such transfers. All third-party transfer costs shall be the sole responsibility of the Guest. SCUBASPA reserves the right to apply a handling fee related with such arrangements. In cases where the transfer is carried out using a SCUBASPA vessel, additional transfer fee shall be charged to the Guest. No refunds shall be issued for late arrivals, or early departures.

5.4 Suite upgrades or downgrades are subject to availability. Where a Guest requests a change from a higher to a lower category suite, the original (higher) rate shall apply, and no refund, onboard credit, or any other form of compensation shall be issued for the price difference. For upgrades to a higher category suite, the Guest shall pay the applicable rate difference.

5.5 SCUBASPA reserves the right, at any time and without prior notice, to modify itineraries, accommodation, or to substitute the cruise vessel where circumstances require or justify such changes. Reasons such as, but not limited to, bad weather and sea conditions, lack of supply availability in the market, government intervention, civil unrest, sudden illness of a key staff member, and force majeure are deemed as reasons beyond the control of SCUBASPA. In such cases, SCUBASPA shall not be liable for any refunds, claims, or compensation of any kind.

6. Change of Travel Dates

6.1 All travel date change requests are subject to availability with respect to occupancy, suite category, and included package components.

6.2 Travel date change is permitted free of charge if requested at least one hundred twenty (120) days prior to the scheduled departure date.

6.3 Travel date changes less than one hundred twenty (120) days prior to the scheduled departure date are not permitted.

7. Travel Documentation and Insurance

7.1 Guests are solely responsible for ensuring they hold valid passports, visas, and vaccination certificates required for entry into the country.

7.2 SCUBASPA shall not be liable for denied boarding or entry due to incomplete or incorrect documentation.

7.3 SCUBASPA strongly recommends purchasing comprehensive international travel insurance prior to departure. Guests are solely responsible for obtaining adequate travel insurance coverage at their own expense. The travel insurance should cover medical treatment, baggage loss or damage, cruise cancellation or interruption, airfare, and any other associated travel expenses.

7.4 For divers, valid diving insurance is mandatory. If such coverage is not secured in advance, a short-term diving insurance policy is available for purchase onboard.

8. Guest Registration Form, Disclaimer and Liability Release Form

8.1 All Guests are required to duly complete the online Guest Registration Form via the electronic signature platform link provided by Scubaspa no later than seven (7) days prior to the start of the cruise.

8.2 Parents or legal guardians traveling with minors are required to sign the Disclaimer and the Liability Release Form via the electronic signature platform link provided by Scubaspa no later than seven (7) days prior to the start of the cruise. For the purposes of these Terms and Conditions, a “minor” is defined as any individual under the age of eighteen (18) years. Minimum age vary by destination and is specified in Section 5 of the relevant Destination-Specific Terms and Conditions.

8.3 Scubaspa reserves the right to deny boarding to any Guest in the event that any required information or documentation is missing, incomplete, or not submitted within the specified timeframe.

9. Diving Requirements and Medical Clearance

9.1 Guests certified as Open Water Divers are allowed to dive to a maximum depth of eighteen (18) meters, while Advanced Open Water Divers may dive to depths of up to thirty (30) meters.

9.2 Night dives and deep dives (deeper than 18 meters) are available only to Guests holding the Advanced Open Water certification or higher.

9.3 Guests wishing to upgrade their certification may enroll in the Advanced Open Water Diver course or selected Specialty courses - subject to prior confirmation with the reservations team.

9.4 All diving Guests are required to complete the Diver Medical Questionnaire, which forms part of the Guest Registration Form. Questions must be answered “Yes” or “No.” A “Yes” response does not automatically disqualify a Guest from diving but indicates a pre-existing condition that could affect their safety. In such cases, certified divers are advised to consult their physician before diving. Guests enrolled in PADI courses must obtain written medical clearance from a physician prior to participation.

9.5 Minimum dive experience requirements vary by destination and are specified in Section 6 of the relevant Destination-Specific Terms and Conditions.

10. Luggage and Prohibited Items

10.1 Each adult Guest is permitted to bring onboard personal belongings necessary for the duration of the cruise.

10.2 Guests are strictly prohibited from bringing onboard any illegal substances, narcotics, fireworks, explosives, weapons, or any hazardous materials or items restricted under applicable law. SCUBASPA reserves the right to deny boarding or disembark any Guest found in possession of such items at the Guest’s own expense and without any right to a refund or compensation.

10.3 Guests are advised to secure all valuables in the in-room mini-safe provided in each suite.

11. Smoking

11.1 Smoking onboard the vessels is strictly prohibited in all interior areas, as well as exterior areas not specifically designated for smoking. Smoking is permitted only in clearly marked designated smoking areas.

11.2 In the event of any violation of this policy, SCUBASPA reserves the right to impose a USD 500 cleaning fee and to disembark the Guest at the Guest’s own expense. In such cases, the Guest shall not be entitled to any compensation or refund. SCUBASPA maintains a strict zero-tolerance policy with respect to smoking violations.

12. Alcohol

12.1 Guests are strictly prohibited from bringing any alcohol on board. SCUBASPA reserves the right to confiscate any alcohol that was not purchased onboard.

12.2 SCUBASPA is committed to responsible service of alcohol and therefore only Guests over the age of eighteen (18) years will be permitted to consume or purchase alcohol. SCUBASPA also reserves the right to refuse the sale of alcoholic beverages to any Guest deemed to be intoxicated.

13. Guest Conduct and Crew Enforcement Rights

13.1 Guests are required to comply with all safety instructions issued by the Captain, Cruise Director, or any authorized crew member.

13.2 Should a Guest’s conduct endanger the safety, well-being, or enjoyment of other persons onboard, the Captain and/or Cruise Director shall have the authority to impose disciplinary measures, or disembark the Guest at the nearest port. In such cases, SCUBASPA shall not be liable for any resulting costs, including but not limited to transportation, accommodation, or repatriation. No refunds or compensation of any kind will be provided in the event of disembarkation due to misconduct.

14. Safety and Security

If a Guest becomes aware of any injury or behavior that is unsafe, illegal, suspicious, or otherwise inappropriate during the cruise, they are required to report the matter immediately to the Captain or a senior member of the crew.

15. Medication and Health Considerations

15.1 Due to the nature of a safari cruise, Guests must ensure that if they are currently taking prescription or long-term medication it is their sole responsibility to ensure that they bring an adequate supply with them to last for the duration of their booked SCUBASPA holiday.

15.2 Medical assistance onboard is limited to basic first aid administered by qualified crew members. Any Guest requiring advanced medical treatment will require moving to shore. Accordingly, SCUBASPA strongly advises all Guests to obtain comprehensive travel insurance.

15.3 In accordance with first aid protocols, SCUBASPA is unable to provide painkillers in any form, therefore Guests are responsible for carrying their own supply of such items.

15.4 Guests must inform SCUBASPA in writing via email - prior to the cruise departure - of any physical, mental, or emotional condition that may require special attention during the cruise. Failure to disclose such information shall release SCUBASPA from any liability for loss, injury, damages, or other compensation arising from or related in any way to that condition.

15.5 Due to the nature of the cruise environment, SCUBASPA is not equipped to accommodate Guests with serious medical conditions.

15.6 If, in SCUBASPA’s sole discretion, a Guest’s condition is deemed to pose a risk to their own safety, health, or enjoyment - or that of others onboard - SCUBASPA reserves the right to deny boarding to the Guest or disembark the Guest to the nearest port.

15.7 SCUBASPA cannot accept Guests who are, or will be, in their twenty-fourth (24th) week of pregnancy or later at any point during the booked cruise. SCUBASPA reserves the right to request relevant medical documentation to confirm this prior to the Guest’s arrival.

16. Other Services and Excursions

Guests may choose to book additional services through SCUBASPA, some of which may be operated by independent third-party providers. Such arrangements, made by or on behalf of the Guest, are undertaken at the Guest’s own risk and shall remain the sole responsibility of the Guest.

17. Special Requests

Guests are encouraged to communicate any special requests before the cruise via email to reservations@scubaspa.com, or, once onboard, by speaking directly with the Captain or Cruise Director. While SCUBASPA will make every reasonable effort to accommodate such requests, no guarantees can be made, and fulfillment is subject to operational limitations.

18. Apparel

18.1 Casual holiday attire is recommended onboard.

18.2 SCUBASPA maintains a strict “no shoes” policy on all vessels, however, flip-flops with soft, light-colored soles are permitted, especially during hot weather when deck may become hot.

18.3 Guests are advised to use sun protection and wear sunglasses while on the sun decks.

19. Electricity

The onboard voltage is 220V/50HZ with international power outlets.

20. Environmental Responsibility

Guests are required to dispose of all waste in the designated containers located throughout the vessel or in the waste bins provided in suites. Under no circumstances should trash or foreign objects be flushed down toilets or disposed of overboard. SCUBASPA enforces a strict no-littering policy in compliance with marine environmental regulations.

21. Weather Conditions

Guests should be aware that SCUBASPA cruises operate in tropical regions where weather conditions can be unpredictable and may include heavy rainfall, strong winds, or sudden changes.

22. Limitation of Liability

22.1 To the extent permitted by law, SCUBASPA shall not be liable for any loss of or damage to Guest property - including but not limited to luggage, medication, valuables, financial means, or electronic devices - or for injury, illness, death, damage or other personal loss, unless directly and solely caused by SCUBASPA’s proven negligence. Guests agree to indemnify and hold harmless SCUBASPA, its owners, employees, and directors from any claims, costs, proceedings, or demands arising from such loss, damage, injury, or death, or resulting from any breach of these Terms and Conditions or the Guest’s own negligence.

22.2 SCUBASPA shall have no responsibility or liability for any Guest’s use of recreational or sports equipment - including, but not limited to scuba equipment - whether supplied by SCUBASPA or otherwise. SCUBASPA shall not be liable for any accidents, injuries, or deaths arising from such use; the actions or negligence of independent contractors; events occurring off-vessel (including on launches or transports); or any shore excursions, tours, or other third-party activities.

22.3 SCUBASPA hereby disclaims all liability to the Guest for damages arising from emotional distress, mental suffering, or psychological injury, unless such damages were the direct result of a physical injury to the Guest intentionally inflicted by SCUBASPA. Without limiting the preceding sentence, in no event shall SCUBASPA be liable to the Guest for any consequential, incidental, exemplary, or punitive damages, except as required by mandatory provisions of applicable law.

22.4 Without limiting the foregoing, in the event of any damage arising from the non-performance or improper performance of the services included in the holiday package under the contract between the Guest and SCUBASPA, the total liability of SCUBASPA shall be limited in accordance with the applicable international conventions governing such services and, in any case, shall not exceed the total remuneration received for a given holiday package.

22.5 Parents or legal guardians hereby assume full responsibility for the safety of minors under their care and agree to release and hold SCUBASPA, its owners, employees, and directors harmless from any and all liability, claims, damages, costs, and causes of action of any kind arising out of or related to any loss, damage, or injury, including death that may be sustained by them and/or their child, from any cause whatsoever, while in or upon the vessel or any premises under the control and supervision of SCUBASPA, its owners, and operators.

22.6 Parents or legal guardians shall be held financially responsible for any damage and all costs associated with the repair of a damage caused by their child(ren). Should a suite be damaged and rendered unfit for use due to the nature of the damage caused, SCUBASPA reserves the right to charge the resulting loss of booking revenue to the parent or legal guardian. This charge shall be calculated based on double occupancy for a minimum of one-week cruise.

22.7 Guests shall be held solely responsible for any damage and/or loss resulting from their violation of these Terms and Conditions.

23. Personal Data Protection

23.1 In order to fulfill its obligations under these Terms and Conditions, SCUBASPA may require certain personal information from each Guest. This may include, but is not limited to, the Guest’s name, address, citizenship, passport number, contact details, flight information, as well as any health or medical conditions, disabilities, or other special needs. The Guest expressly consents to the collection and processing of personal information as described herein.

23.2 SCUBASPA may share all personal information received from the Guest with relevant third parties, including but not limited to travel operators, hotels, airlines or other transport providers, credit and debit card companies, or governmental and public authorities. Such disclosure may occur where required by applicable law or regulations, or where necessary for these parties to provide their services to the Guest effectively. The Guest expressly consents to the transfer of personal information as described herein.

23.3 SCUBASPA reserves the right to use photographic or video images of Guests taken onboard the vessel or otherwise during the cruise holiday for marketing, promotional, or other business-related purposes.

24. Force Majeure

The obligations outlined in these Terms and Conditions shall be considered void or suspended in circumstances of force majeure. Force majeure shall include, but is not limited to: acts of God, civil unrest, war and war-like conditions, strikes, natural catastrophes, perils of the sea, fire, theft, epidemics, acts of terrorism, and government-ordered measures such as closures, travel bans, or operational restrictions that jeopardize the ability of either the Guest or Scubaspa to fulfill their contractual obligations. Under such conditions, Scubaspa shall not bear any direct or indirect liability to the Guest for the failure to operate or perform any part of the agreed services.

25. Miscellaneous

The illegality or invalidity of any paragraph, clause, or provision of these Terms and Conditions shall not affect or invalidate any other paragraph, clause, or provision herein. All headings included in these Terms and Conditions are provided for convenience only and shall have no independent meaning or interpretive effect.

Destination-Specific Terms and Conditions

SCUBASPA MALDIVES

1. Holiday Packages and Scope of Service

1.1 All holiday packages are subject to availability. Scubaspa Maldives offers six (6) types of holiday packages:

a. Seven (7) Nights Scuba Holiday Package

b. Seven (7) Nights Spa Holiday Package

c. Seven (7) Nights Scuba and Spa Holiday Package

d. Four (4) Nights Scuba Holiday Package

e. Four (4) Nights Spa Holiday Package

f. Four (4) Nights Scuba and Spa Holiday Package

1.2 All holiday packages include:

a. Transfers to and from the nearest domestic airport (i.e. the airport closest to the vessel’s anchorage location) on scheduled arrival and departure days and times.

b. Full board accommodation

c. Welcome drink

d. Unlimited drinking water, selection of teas and coffee

e. Yoga classes

f. Snorkeling

g. Beach BBQ

h. Excursions

i. 5 GB data internet package per suite

1.3 The Seven (7)-Night Scuba Holiday Package includes:

a. Up to (17) dives (tanks and weights included)

1.4 The Seven (7)-Night Spa Holiday Package includes:

a. Eight (8) classic spa treatments

1.5 The Seven (7)-Night Scuba and Spa Holiday Package includes:

a. Up to six (6) dives (tanks and weights included)

b. Four (4) classic spa treatments

1.6 The Four (4)-Night Scuba Holiday Package includes:

a. Up to nine (9) dives (tanks and weights included)

1.7 The Four (4)-Night Spa Holiday Package includes:

a. Four (4) classic spa treatments

1.8 The Four (4)-Night Scuba and Spa Holiday Package includes:

a. Up to four (4) dives (tanks and weights included)

b. Two (2) classic spa treatments

SCUBASPA will make every reasonable effort to deliver the number of dives specified above. However, the actual number of dives may be affected by weather or sea conditions or other operational factors beyond SCUBASPA’s control. In all cases, the safety of Guests and crew will take priority, and SCUBASPA cannot guarantee that all scheduled dives will be completed.

2. Check-In and Check-Out Times

2.1 All seven (7)-night cruises, unless otherwise stated, begin and end on Saturday. Check-in is available from 1:00 PM on the arrival day. Check-out time is 8:45 AM on the departure day.

2.2 All Four (4)-night cruises, unless otherwise stated, begin on Saturday and end on Wednesday. Check-in is available from 1:00 PM on the arrival day. Check-out time is 1:45 PM on the departure day.

3. Transfers

3.1 For seven (7)-night cruises the package rate includes transfers from and to the following airports:

Best of Maldives

• Malé to Malé: Transfer from and to Velana International Airport (MLE)

Deep South Expedition

• Malé to Kooddoo: Transfer from Velana International Airport (MLE) and to Kooddoo Airport (GKK).

• Kooddoo to Gan: Transfer from Kooddoo Airport (GKK) and to Gan International Airport (GAN).

• Gan to Kooddoo: Transfer from Gan International Airport (GAN) and to Kooddoo Airport (GKK).

• Kooddoo to Malé: Transfer from Kooddoo Airport (GKK) and to Velana International Airport (MLE).

Far North EXPEDITION

• Malé to Dharavandhoo: Transfer from Velana International Airport (MLE) and to Dharavandhoo Airport (DRV).

• Dharavandhoo to Dharavandhoo: Transfer from and to Dharavandhoo Airport (DRV).

• Dharavandhoo to Malé: Transfer from Dharavandhoo Airport (DRV) and to Velana International Airport (MLE).

3.2 For four (4)-night cruises the package rate includes transfers from Velana International Airport (MLE) and to Villa International Airport Maamigili (VAM).

4. Supplements and Reductions

4.1 A single-stay supplement of twenty-five percent (25%) applies to all cruises except those specified in Section 4.2.

4.2 A single-stay supplement of fifty percent (50%) applies to Deep South Expeditions, Christmas, and New Year cruises.

4.3 A fifteen percent (15%) supplement applies to all packages during Christmas and New Year cruises.

4.4 A ten percent (10%) supplement applies to all packages during Deep South Expeditions.

4.5 Triple occupancy is available in Cowrie Suite (suite no 7) and Sea Star Suite (suite no 10). The third person in a triple suite booking is eligible for a twenty-five percent (25%) discount.

5. Minors

5.1 Children under the age of ten (10) are not permitted onboard SCUBASPA Maldives vessels. Scubaspa Maldives cruises are not suitable for young children, as the vessels are not equipped with the necessary safety features, facilities, or entertainment options to accommodate their needs.

5.2 For safety and quality reasons, children aged ten (10) and eleven (11) must be accompanied by a private guide, which is subject to an additional fee. This requirement applies when the child is booked on a holiday package that includes scuba diving, ensuring a more personalized and secure experience tailored to the child’s abilities and safety.

6. Minimum Dive Experience

6.1 Only Guests who hold at least a PADI Open Water certification or an internationally recognized equivalent are eligible to book Scubaspa Maldives holiday packages that include scuba diving other than scuba diving courses.

6.2 Guests who hold a PADI Scuba Diver certification or an internationally recognized equivalent are required to book a Scuba and Spa Holiday Package. If a Scuba Diver Guest wishes to book a Scuba Holiday Package, they must be accompanied by a private guide, which is subject to an additional fee.

7. Drones

To operate a drone in the Maldives, Guest must obtain prior approval from the Maldives National Defense Force (MNDF) and a permit from the Maldives Civil Aviation Authority (MCAA). Permit requests must be submitted to the MCAA via email at ans@caa.gov.mv.

Drone operation is subject to the following conditions:

a. Drones may only be flown during daylight hours and in good weather conditions

b. Drones must not exceed a maximum altitude of four hundred (400) feet (122 meters) above ground level

c. Flying drones over people is strictly prohibited

d. Drones must not be flown near military installations, power plants, or any other area that could cause concern among local authorities

e. Drones must not be flown near airports or in areas where aircraft operations are taking place

8. Onboard Currency

The official currencies accepted onboard Scubaspa Maldives vessels are US Dollars (USD) and Euros (EUR). The following credit cards are accepted onboard: Visa, Mastercard, and American Express (Amex). Please note that all credit card payments are subject to a four percent (4%) processing fee.

SCUBASPA will make every reasonable effort to deliver the number of dives specified above. However, the actual number of dives may be affected by weather or sea conditions or other operational factors beyond SCUBASPA’s control. In all cases, the safety of Guests and crew will take priority, and SCUBASPA cannot guarantee that all scheduled dives will be completed.

2. Check-In and Check-Out Times:

2.1 For eleven (11), ten (10), nine (9), and seven (7) Night Cruises:

a. Check-in time is between 7 AM and 12 PM on the arrival day.

b. Pick-up from previous accommodation may be arranged between 9:00 AM and 12:00 PM on the arrival day.

c. Check-out time is between 9:00 AM and 12:00 PM on the departure day.

3. Transfers

3.1 For all cruises the package rate includes transfers from and to the following airports:

4. Supplements and Reductions

4.1 A single-stay supplement of fifty percent (50%) applies to all cruises except those specified in Section 4.2.

4.2 A single-stay supplement of seventy-five percent (75%) applies to Christmas and New Year cruises.

4.3 A fifteen percent (15%) supplement applies to all packages during Christmas and New Year.

4.4 Triple occupancy is available in the Owner’s Manta Suite and the Cowrie Suite. The third guest in a triple occupancy booking is eligible for a twenty-five percent (25%) discount.

5. Minors

Children under the age of fifteen (15) are not permitted onboard SCUBASPA Indonesia vessel. Scubaspa Indonesia cruises are not suitable for young children, as the vessel is not equipped with the necessary safety features, facilities, or entertainment options to accommodate their needs.

6. Minimum Dive Experience

6.1 Only Guests who hold a PADI Advanced Open Water certification or an internationally recognized equivalent are eligible to book Scubaspa Indonesia holiday packages that include scuba diving, with the exception of Guests who are enrolled in a scuba diving course onboard that includes obtaining the Advanced Open Water certification as part of their holiday package.

6.2 Only guests who meet the following minimum dive requirements are eligible to book SCUBASPA Indonesia holiday packages that include scuba diving, excluding scuba diving courses:

a. Raja Ampat, Triton Bay, Forgotten Islands expeditions: minimum of 30 logged dives

b. Komodo expeditions: minimum of 50 logged dives

7. DRONES

Guests intending to operate drones during their cruise are required to comply with all applicable Indonesian aviation regulations. Based on Scubaspa’s research and interpretation of current laws, the following key rules apply:

7.1 General Drone Regulations in Indonesia:

a. Drones may not fly above one hundred fifty (150) meters (492 feet) without prior permission.

b. Drones must not exceed a maximum weight of seven (7) kilograms (15.4 pounds).

c. Drones may not be flown within fifteen (15) kilometers (9.32 miles) of any airport.

d. Drones may not be flown over crowds or densely populated areas.

e. Nighttime drone operations are not permitted.

f. Drones may not be flown from any moving vehicle.

g. The drone pilot must maintain a direct line of visual sight at all times while flying.

h. Non-compliance with these regulations may result in severe penalties, including imprisonment and possible fines of up to approximately seventy-seven thousand (77,000) USD.

7.2 Airspace Restrictions:

a. Forbidden Areas: Require prior permission from the Director General of Air Transportation (DGTA).

b. Prohibited Areas: Entirely closed to aviation activities of any kind (e.g. government offices, police stations or military bases).

c. Restricted Areas: may be open for civil aviation but restricted for government or official use.

d. Airport Vicinity: All areas within proximity to airports, for safety purposes.

e. Controlled Airspace where control services for air traffic is provided

f. Uncontrolled Airspaces above one hundred fifty (150) meters from ground level.

7.3 Komodo National Park Specific Regulations:Any use of drones within Komodo National Park must be reported to Balai Taman Nasional Komodo, and a permit must be obtained in advance. An application letter must be submitted indicating the exact location, the name of the Guest operating the drone, and the intended duration of use. The approximate fee for drone use within the Park is one million (1,000,000) IDR per expedition.PLEASE NOTE: Drone use is strictly forbidden in certain areas, such as Kalong Island.
